Terms of Service

1. Acceptance of Terms By accessing and using the website https://originstake.com/ (“Website”) as well as the staking services and related digital services (“Services”) provided by OriginStake (“OriginStake”, “we”), you – as an individual or representative of an organization (“User”, “you”) agree to be bound by these Terms of Service (“Terms”). Please read the Terms carefully before using. If you do not agree, please do not access the Website or use any of the Services.
2. Amendment of Terms OriginStake reserves the right to modify or supplement the Terms at any time without prior notice. The updated version will take effect immediately upon posting on the Website. You are responsible for regularly reviewing any changes. Continued use of the Services after new Terms are posted constitutes your acceptance of those changes.
3. Conditions of Use
   1. Only individuals aged 18 or older are permitted to use the Services.
   2. Some services may be subject to additional terms and conditions. In such cases, your use of those Services will be understood as your acceptance of the additional terms as well.
   3. The information on the Website is not intended for distribution to any country where such distribution is illegal. If you access the Website from an address outside of Vietnam, you are responsible for compliance with all applicable local laws.
4. Definitions
   1. “Blockchain”: a distributed digital ledger that is not controlled by any single individual/organization and accounts on which can only be operated using private keys.
   2. “Cryptocurrency”: decentralized, digital currencies tracked by Blockchain, including but not limited to: Bitcoin, Ethereum, BNB, XRP, Cardano, Solana, Polkadot, Avalanche…
   3. “User Data”: all data, files, and information provided by the User to OriginStake during the use of the Services.
   4. “User Funds”: the Cryptocurrencies owned by the User or authorized to be managed by OriginStake.
   5. “Staking Rewards”: all Cryptocurrencies received by the User as revenue from staking on the blockchain/network platform, including block rewards, transaction fees, service commissions…
5. OriginStake Services
   1. We operate Staking nodes (Validator nodes) to support the consensus function of various blockchains. When you stake Cryptocurrencies to OriginStake’s network nodes, you are “delegating” your tokens to us. Specifically, delegation here does not mean that you transfer ownership or control of your tokens to OriginStake. Your tokens will remain in your wallet and only you can access them with your private key. Instead, token delegation allows OriginStake to participate in the blockchain consensus process on your behalf by using the “voting power” corresponding to the number of tokens you have delegated. We will perform verification transactions and propose new blocks to the blockchain on your behalf, following the consensus protocol. OriginStake does not directly hold or control your tokens. We only act as a representative for your voting power on the network. You retain full control over the number of tokens delegated and the delegation period. You can undelegate at any time to regain full control of your tokens, subject to the unstaking time specified by each blockchain. All Staking Rewards you receive originate from the corresponding blockchain protocol, based on the performance of the network node and the token stake ratio. OriginStake only acts to receive rewards on your behalf and transfer the rewards to your account after deducting the service fee at the announced rate.
   2. We maintain the necessary technology infrastructure (hardware, software, network connections…) to ensure stable operation of the network nodes. However, due to the complexity of the blockchain system, we cannot guarantee that the staking service will operate continuously without interruption or error.

   4. You are fully responsible for your decision regarding the choice of cryptocurrency, quantity, and staking duration.
   5. Staking Rewards may change over time, depending on many factors such as the staking protocol, the amount of cryptocurrency participating, the average stake ratio, the performance of the blockchain network… OriginStake does not guarantee profits or fixed rates of return.
   6. You accept all risks associated with the use of the staking service, including but not limited to: token lock-up, token loss due to consensus errors, penalties (slashing) for violating network rules, failure to receive rewards due to network interruptions or software errors originating from the blockchain.
   7. OriginStake will charge a reasonable fee from the Staking Rewards you earn. This fee will be automatically deducted when distributing rewards. The fee rate may be adjusted over time and will be announced in advance on the Website.
6. OriginStake’s Responsibilities
   1. Protecting User Data: We are committed to keeping your personal information and transaction data confidential in accordance with our privacy policy, except in cases where it must be provided as required by competent state authorities.
   2. Maintaining system operation: We strive to ensure that the Website and services operate stably and securely. However, we are not responsible for any losses or disadvantages you may incur due to system interruptions, software errors, or other technical incidents.
   3. User support: Our support team is ready to assist and answer your questions during the use of the service. You can contact us via email or the support channels provided on the Website.
7. User Responsibilities
   1. Compliance with the law: When using the Services, you commit to comply with these Terms as well as all relevant legal provisions, including anti-money laundering (AML) laws, tax regulations, counter-terrorism financing…
   2. Providing accurate information: You are responsible for updating your personal information and contact information accurately and completely. OriginStake is not responsible for any losses arising from your provision of inaccurate or incomplete information.
   3. Account security: You are fully responsible for safeguarding your login information, passwords, private keys, and other authentication data. You must immediately notify OriginStake if you suspect any unauthorized access to your account.
   4. Not abusing the Services: You commit not to perform any actions that may harm the Website, Services, or negatively affect the experience of other users, including: DDoS attacks, spreading malware, exploiting security vulnerabilities, unauthorized access…
8. Fees and Taxes
   1. OriginStake will charge a certain fee from the Staking Rewards you receive to cover the costs of system operation and service development. This fee will be automatically deducted before distributing rewards to your account.
   2. From time to time, we may change the service fee schedule to suit market conditions. Any changes to fees will be notified in advance on the Website or via email to you.
   3. You are fully responsible for declaring and paying any taxes or fees arising from the use of the Services (if any) as required by law. OriginStake does not provide tax advice and is not responsible for any tax issues related to you.
9. Limitation of Liability
   1. To the fullest extent permitted by law, OriginStake, its affiliates, directors, and employees will not be liable for any direct, indirect, incidental, special, or consequential losses arising out of or in connection with:
   2. Your use or inability to use the Website and Services;
   3. Any changes, suspension, or termination of the Services;
   4. The depreciation of cryptocurrencies sent for staking;
   5. Software errors, system failures, network connection issues, or any other technical errors;
   6. Unauthorized access, network attacks targeting your account or digital wallet;
   7. Any interruptions, delays, errors, or data loss occurring during the use of the Services;
   8. Any other damages arising from your use of the Services.
      1. OriginStake provides the Services on an “as is” and “as available” basis, without any warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, ownership, and non-infringement of third-party rights.
      2. OriginStake has the right to refuse to provide services or terminate or suspend your account if it suspects that you have violated these Terms or any applicable laws.
10. Intellectual Property Rights
    1. 10.1 All intellectual property rights to the Website, Services, and all related content (including but not limited to source code, interfaces, databases, logos, images, sounds, videos, text…) belong to OriginStake or its licensed parties. All rights not expressly granted in these Terms are reserved.
    2. Except as permitted by these Terms, you may not copy, modify, distribute, reproduce, publicly display, reverse engineer, decompile, disassemble, translate, or create derivative works from any part of the Website or Services.
    3. To the extent permitted, you are granted a limited, non-exclusive, non-transferable, revocable right to access and use the Website and Services for personal, non-commercial purposes.
11. User-Generated Content
    1. By posting, submitting, transmitting, or displaying content through our Website or Services, you grant OriginStake a non-exclusive, transferable, sublicensable, perpetual, irrevocable right to use, reproduce, modify, translate, distribute, publicly display, and create derivative works from that content worldwide, through any media, for any lawful purpose related to the provision and operation of the Services.
    2. You acknowledge and warrant that you own or have obtained the necessary permissions to grant the rights set forth above for all content you post. You are fully responsible for the legality, reliability, appropriateness, and copyright of the content you post.
12. Links to Third-Party Websites
    1. Our Website and Services may contain links to third-party websites or services. These links are provided for informational purposes and your convenience only.
    2. OriginStake does not control, endorse, or approve the content, accuracy, or views expressed on the linked websites and services. OriginStake is not responsible for any losses or damages arising from your access to and use of those linked websites or services.
    3. Your access to third-party links will be subject to the terms of service and privacy policies of the respective websites. You should carefully review these policies before using their services.
13. Termination and Suspension
    1. OriginStake has the right to unilaterally suspend or terminate the provision of some or all of the Services at any time without prior notice to you, for the purpose of maintenance, system upgrades, compliance with legal regulations, or any other justifiable reason.
    2. We also have the right to suspend or terminate your account if you violate any of the terms of this agreement or if your conduct negatively affects the experience of other users.
    3. You may terminate your account at any time by sending a request to our customer support email address. Termination of the account will not affect the rights or obligations of either party arising before the date of termination.
14. Indemnification
    1. Your violation of these Terms;
    2. Your use of the Services;
    3. Content created and posted by you through the Services;
    4. Your intentional or negligent misconduct related to the Services;
    5. Your violation of the rights of any third party.
15. Governing Law and Dispute Resolution
    1. These Terms shall be governed, construed, and enforced in accordance with the laws of Vietnam, regardless of conflict with other legal principles.
    2. Any disputes or claims arising out of or in connection with these Terms or the Services shall first be resolved through negotiation and mediation. If no common agreement is reached within 30 days, either party has the right to bring the case to the Vietnam International Arbitration Center (VIAC) for resolution. The arbitral award shall be final, binding, and non-appealable.
16. Miscellaneous
    1. These Terms constitute the entire agreement between you and OriginStake, superseding and merging all prior agreements between the two parties on this matter.
    2. The invalidity or unenforceability of any term will not affect the validity of the remaining terms. They shall be construed and interpreted in a manner most consistent with the original intent of the parties.
    3. OriginStake has the right to assign or transfer some or all of its rights and obligations under this agreement without your prior consent. Meanwhile, you may not assign or transfer any rights or obligations without our prior written approval.
    4. OriginStake’s failure to enforce or delay enforcing any rights or remedies under this agreement shall not be construed as a waiver of those rights or remedies, nor shall it prevent their enforcement in the future.
    5. The headings and terms are for convenience only and do not affect the interpretation of the content of this agreement.
